JOHANNESBURG — Business lobby group Sakeliga has launched a new court application aimed at blocking the roll-out of South Africa’s controversial National Health Insurance (NHI) scheme.
The move comes in the wake of mounting legal pressure on the government’s health reforms, and directly targets the National Department of Health’s bid to consolidate and stay all constitutional challenges to the NHI while implementation proceeds.
Government Seeks to Consolidate Cases
The Health Department, led by Aaron Motsoaledi, has applied to the courts to merge several pending legal challenges into a single case, and to suspend (“stay”) all constitutional arguments until procedural disputes are resolved. The department says this will save time and money.
Sakeliga argues this strategy is a tactic to buy time, allowing the government to continue rolling out aspects of the NHI scheme while key legal objections remain unresolved. “This tactic amounts to an abuse of process … while inflicting ongoing harm on the public, taxpayers, healthcare services, and the economy,” the group stated.
Counter-Application to Stop Implementation
In response, Sakeliga has filed a conditional counter-application seeking an interim interdict to halt any further implementation of the NHI scheme if the court grants the government’s stay request. The organisation contends that proceeding with rollout under legal uncertainty would be unconstitutional and could cause irreversible harm.
According to Sakeliga, allowing the NHI to advance while critical constitutional issues remain pending would deny affected parties timely judicial review and undermine the rule of law.
Implications for South African Healthcare & Economy
Critics of the NHI argue that the legislation is unaffordable, lacks transparent funding mechanisms and threatens the private healthcare sector, which many South Africans currently rely on.
Proponents say the scheme is essential for achieving universal healthcare coverage in South Africa’s deeply unequal system, but they face a series of legal, fiscal and operational hurdles. The current litigation adds another layer of uncertainty to the scheme’s implementation timeline.
